REASONS

The judgment was given during a telephone hearing held on 25/9/2020. The Claimant confirmed the contents of the ET1. I also examined various documents such as payslips sent by the Claimant. The Second rather than the First Respondent was the Claimant’s employer. She issued her ET1 against the First Respondent. It is in the interests of justice to join the Second Respondent so the correct party can be held liable to pay the money that it owes. The Claimant informed me that the company via Mr Hassim is fully aware of her claim. I find that the Second Respondent owes the Claimant £2353.85 being the net amount shown due to the Claimant for the period to 17/4/2020 in her P45 issued by the Second Respondent on 27/4/2020 but not in fact paid to her, plus £328.32 being the aggregate of sums deducted by the Second Respondent from the Claimant’s pay in February and March 2020 in respect of employee pension contributions plus employer pension contributions neither of which have been paid into the Claimants pension plus holiday pay due on termination.
