Employment Tribunals Rules of Procedure 2013 – Rule 21[1]The respondent has failed to pay the claimant’s holiday entitlement and is ordered to pay the claimant the sum of £826.32.[2]The Tribunal does not have jurisdiction to consider the claimant’s complaints of unfair dismissal, wrongful dismissal and breach of contract because they are based on domestic law and the respondent has the benefit of state immunity from these claims pursuant to the State Immunity Act 1978. The Claimant’s complaints of unfair dismissal, wrongful dismissal and breach of contract are therefore dismissed.
