Employment Tribunals Rules of Procedure 2013 – Rule 21 The Respondent has failed to present a response to the claims within the time prescribed by the Tribunal’s Rules. The judgment of the Tribunal is as follows: First Claimant: Mrs S Mohamed Ibrahim Mohamed Ahmed[1]The Respondent has made an unauthorised deduction from the First Claimant's wages and is ordered to pay the First Claimant the gross sum of £11,255.04. This is comprised of £9,666.00 for non-payment of salary for the months of March to June 2019 and 20 days’ unpaid holiday pay of £1,589.04.[2]The First Claimant was dismissed in breach of contract in respect of notice and the Respondent is ordered to pay damages to the First Claimant in the net sum of £1,915.13, being one month’s net pay.[3]The total sum payable by the Respondent to the First Claimant is £13,170.17. Second Claimant: Mrs LHShembish[4]The Respondent has made an unauthorised deduction from the Second Claimant’s wages and is ordered to pay the Second Claimant the gross sum of £14,071.23. This is comprised of £12,000 for non-payment of salary for the months of March to June 2019 and 21 days’ unpaid holiday pay of £2,071.23.[5]The Second Claimant was dismissed in breach of contract in respect of notice and the Respondent is ordered to pay damages to the Second Claimant in the net sum of £6,785.73, being 3 months’ net pay. 4.17 Rule 21 judgment – universal template. Third Claimant: Mr W Wagdy[7]The Respondent has made an unauthorised deduction from the Third Claimant’s wages and is ordered to pay the Third Claimant the gross sum of £14,360.72. This is comprised of £12,333.33 for non-payment of salary for the months of March to June 2019 and 20 days’ unpaid holiday pay of £2,027.39.[8]The Third Claimant was dismissed in breach of contract in respect of notice and the Respondent is ordered to pay damages to the Third Claimant in the net sum of £6,950.52, being 3 months’ net pay.[9]The total sum payable by the Respondent to the Third Claimant is £21,311.24. All Claimants[10]The Tribunal does not have jurisdiction to order the provision of P45 or P60 documents.
