Ms J Power v Blue Groove Soundz: 2202278/2020
JUDGMENT
[1]The Respondent failed to file an ET3 Grounds of Resistance by the required date of 16 June 2020, and no explanation has been provided for its failure to do so, nor an application made pursuant to Rule 20 of the Employment Tribunals (Constitution & Rules of Procedure) Regulations 2013 (the Rules) for an extension of time to do so.[2]Having considered the ET1, Employment Judge Nicolle has decided that a determination of the claim can properly be made without a hearing and the Judgment of the Tribunal, made under Rule 21 is as set out below.[3]The Respondent has unlawfully failed to pay wages to the Claimant for a total of 91 hours worked between 25 November 2019 and 24 December 2019. Given that the Claimant’s hourly wage was £12 this equates to a gross figure of £1,092.[4]The Tribunal orders the Respondent to pay unpaid wages to the Claimant of £1,092 gross. The Claimant will be responsible for the payment of all applicable tax and employee national insurance contributions on this sum.
