JUDGMENT

[1]The name of the Respondent on the Tribunal’s file is amended so as to add the words “in liquidation”.[2]The Claimant has permission to amend the claim so as to add the following complaints:2.1 Unlawful deduction from wages in respect of April and May 2020.2.2 Non-payment of notice pay (breach of contract).[3]The complaint of unlawful deduction from wages is well founded. The Respondent shall pay to the Claimant compensation as follows:3.1 Gross pay for the months of March 2020 (£2,277.60); April 2020 (£2,277.60) and May 2020 (up to 12 May, £881.65).3.2 Commission payments, net of tax and national insurance, of £7,202.08. Case Number: 2202191/2020[4]The complaint of breach of contract (non-payment of notice pay) is well founded. The Respondent shall pay to the Claimant compensation of 1 month’s net pay, being £1,823.00.[5]Pursuant to Rule 76, the Tribunal considering that the Respondent has acted unreasonably in the way that the proceedings have been conducted, the Respondent shall pay to the Claimant the sum of £480.00 by way of a preparation time order.[6]The total sum payable by the Respondent to the Claimant is £14,941.93.
