The claim is struck out.REASONS
[1]By a letter dated 22 October the respondent wrote to the Tribunal asking for the claim to be struck out because the claimant(1) had failed to comply with the Tribunal orders of 1 October and(2) was not actively pursuing the claim.[2]The claimant was told to send any objections to the Tribunal as soon as possible. The claimant was reminded of the application on 29 October and 18 November but has made no contact with the Tribunal.[3]In the circumstances, and since the failure to comply has not been remedied and the claimant’s silence demonstrates a failure to actively pursue, the claim is struck out because:• the claimant had not complied with the Order of the Tribunal dated 1 October 2019 and• it has not been actively pursued.[4]The Employment Judge apologises to the respondent for the delay in acknowledging the application.[5]The hearing fixed for 9 December will not take place.
