JUDGMENT
The Judgment of the Tribunal, delivered orally at the hearing, is that:[1]The claim of automatic unfair dismissal for making a public interest disclosure pursuant to s103A Employment Rights Act 1996 (‘ERA’) is dismissed;[2]The claim of detriment for making a public interest disclosure pursuant to s47B ERA is dismissed; Case No: 2202071/2024[3]The claim of ordinary unfair dismissal pursuant to s98(4) ERA shall continue to trial.[4]The claim of unlawful deduction from wages pursuant to s13 ERA shall continue to trial.[5]If either party considers that the 10 day time estimate is too long they should write to each and the Tribunal stating why and proposing a shorter timetable by 28th November 2024.[6]The Mediation case management hearing currently listed for 25th November 2024 shall be vacated on the grounds that the remaining claims no longer qualify for mediation.
