[1]By a letter dated 15 November 2024 EJ Brown gave the Claimant an opportunity to make representations or to request a hearing, as to why the claim should not be struck out because You have not complied with the Order of the Tribunal dated 12 September 2024, sent to parties on 14 September 2024, ordering you to send the Respondent a Schedule of Loss by 10 October 2024, and to send the Respondent a disability impact statement and any medical evidence in support of your disability by 24 October 2024. The claim has not been actively pursued. You have not complied with the orders and you have not responded to the Respondent’s correspondence regarding this.[2]EJ Brown gave the Claimant until 22 November 2024 to respond. The Claimant has failed to make any representations in writing why this should not be done or to request a hearing. The claim is therefore struck out.[3]The final hearing listed for 5 days on 31 March, 1 – 4 April 2025 is cancelled.
