JUDGMENT

The claim is struck out because it has not been actively pursued.

REASONS

[1]The tribunal had received no reply from the claimant to communications sent by the tribunal to the claimant on respectively 22 April 2024 and 25 June 2024. The latter specifically asked the claimant to indicate whether she wished to continue with her claim or whether her claim had been settled or withdrawn.[2]On 28 June 2024, the tribunal issued a strike out warning to the claimant, noting that EJ Baty was considering striking out the claim because it had not been actively pursued and informing the claimant that, if she wished to object to this proposal, she should by 12 July 2024 give her reasons in writing or request a hearing at which she could make them. The tribunal has received no response from the claimant.[3]I therefore consider that the claim has not been actively pursued. Furthermore, the tribunal has made several attempts to contact the claimant without receiving any response from her. I therefore consider that it is appropriate in these circumstances to exercise my discretion to strike the claim out on the basis that it has not been actively pursued. The claim is therefore struck out.
