The claim is struck out as an abuse of process.REASONS
The claimant submitted claim number 2200450/2022 on 31 January 2022. He then applied to amend that claim on 4 February 2022, the day after his dismissal, to include a complaint of unfair dismissal, and that amendment has now been allowed. This separate complaint was then presented covering the same factual matters and legal complaints, save that it added a complaint of automatically unfair dismissal for raising a protected disclosure. The claimant now accepts that he did not personally make a protected disclosure. Accordingly, the second claim adds nothing to the first claim and is an abuse of process. It therefore meets the test for a strike out under Rule 37(1)(a) of the Employment Tribunal Rules of Procedure.
