JUDGMENT

[1]Judgment for the claimant in her claims for:1.1 Unlawful deductions from wages1.2 Race discrimination1.3 Sex discrimination 2.Remedy will be decided at the hearing on 16 September, which is converted to an open hearing. 3.The claimant lacks qualifying service for an unfair dismissal claim.

REASONS

[1]On 13 July the claim form was sent to the respondent which was to respond on ET3 by 10 August. The respondent did not respond. A warning was sent on 18 August that judgment was about to be issued against it, but today there is still no reply.[2]Accordingly judgment is entered in default on the claims, save the unfair dismissal claim, as on the face of it the claimant lacks two years qualifying service.[3]It is not possible to assess the amount claimed from the information on the file. The claimant must bring to the hearing all documents relating to her pay, whether pay slips, contracts, emails, texts or bank information, which will assist in showing what she as owed and what she was paid.
