JUDGMENT
[1]The judgment of the Tribunal is that:(1) The Claimant’s claim for unfair dismissal is struck out under Rule 37(1)(a) because he does not have two years’ qualifying service as required by s 108(1) of the Employment Rights Act 1996 and there is therefore no prospect of success on that claim.(2) The Respondent’s application to strike out the Claimant’s age discrimination claim under Rule 37(1)(a) is refused. JUDGMENT[2]The Claimant having failed to pay the deposit order of 28 September 2022, his age discrimination claim is struck out pursuant to Rule 39(4).
