JUDGMENT
Pursuant to rule 37(1)(d) of the Employment Tribunals Rules of Procedure 2013, the claim form is struck out on the ground that it has not been actively pursued.REASONS
[1]On 11 April 2019 the Claimant presented a claim form containing complaints of unfair dismissal and racial discrimination and a claim for unpaid wages.[2]The Respondents did not present a response and it later emerged that they were in administration. The administration ended on 29 October 2019. The Respondents are in liquidation.[3]By a letter of 19 July 2021 the Tribunal advised the Claimant that the Respondents were in liquidation and asked if she wished to proceed to a hearing. She did not reply.[4]On 13 August 2007 the Tribunal wrote to the Claimant stating that a judge was considering striking out the claim on the ground that it was not being actively pursued, and inviting her to show cause why such a judgment should not be given.[5]No reply having been received, and it being impracticable to progress the case without the Claimant’s co-operation, I strike out the claim form under rule 18(1)(d) of the Employment Tribunals Rules of Procedure 2004.
