Ms S Davies v Omega Pharma Ltd: 2201176/2022
JUDGMENT
The claimant’s claim is struck out.REASONS
[1]By a letter dated 13 October 2022, the Tribunal gave the claimant an opportunity to make representations or to request a hearing, as to why the claim should not be struck out because• the manner in which the proceedings have been conducted by or on behalf of the claimant has been scandalous, unreasonable or vexatious;• the claimant had not complied with the Orders of the Tribunal dated 1 June 2022;• it has not been actively pursued;• it is no longer possible to have a fair hearing of the claim, because case management orders have not been complied with and there is a nine day hearing listed for January/February 2023.[2]The claimant has failed to make representations in writing why this should not be done or to request a hearing. The claim is therefore struck out. 1 of 2 Case Number: 2201176/2022[3]The hearing fixed for 31 January to 10 February 2023 will not take place. EJ Davidson 25 October 2022
