JUDGMENT

[1]The Claimant was an employee of the Respondent. The contract of employment terminated on 5 December 2016.[2]The Claimant’s complaint of unauthorised deduction of wages for the period 1 November 20165 December 2016 succeeds. The Respondent is ordered to pay to the Claimant the sum of £6294.90 (net) in respect of unpaid salary during that period[3]The Claimant’s complaint of unauthorised deduction of wages in respect of 6 days accrued but untaken annual leave succeeds. The Respondent is ordered to pay to the Claimant the sum of £1510.74 (net).[4]The Claimant’s complaint of wrongful dismissal fails and is dismissed.[5]The Respondent’s counter claim for breach of contract fails and is dismissed. 10.2 Judgment - rule 61 Case No: 2200683/2017[6]Following the Order made by Employment Judge Clark dated 22 September 2017, arising from the Respondent’s late application for an adjournment of the preliminary hearing, the Respondent is ordered to pay costs to the Claimant in the sum of £700.
