JUDGMENT
The tribunal does not have jurisdiction to hear the claimant’s complaints of unfair dismissal and unlawful deduction from wages.REASONS
[1]The claimant was employed from 22 January 2021 to 3 September 2021. He does not have sufficient service to bring an unfair dismissal claim. It is therefore dismissed as the tribunal does not have jurisdiction to hear it.[2]The claimant’s claim for unlawful deductions from wages was brought outside the statutory time limit. Even if the revised promised payment date (1 November 2021) is taken as the relevant date rather than the contractual payment date (23 September 2021), the claim was presented late on 15 February 2022. ACAS early conciliation started and ended on 15 February 2022, the same date as the claim was presented. The claimant failed to show that it was not reasonably practicable to bring the claim within the time limit. The claim is therefore dismissed as the tribunal does not have jurisdiction to hear it..
