JUDGMENT
[1]The claim was issued in the London Central Employment Tribunal on 05 February 2022. The respondent failed to present a valid response on time.[2]The claim was heard on 21 April 2022. The respondent was notified of the hearing but did not attend.[3]The respondent has made unauthorised deductions from the claimant’s wages and is ordered to pay the claimant £891 gross.[4]The claimant was entitled under section 1 of the Employment Rights Act 1996 to be provided with a written statement of employment particulars which the respondent failed to do. I find it just and equitable in the circumstances to order the respondent to pay the Claimant an additional 2 weeks’ pay for this failure, in accordance with section 38 Employment Act 2002. The respondent is ordered to pay the claimant £1,620.[5]The respondent must pay the claimant £2,511 gross, in total.[6]The respondent will be entitled to deduct any tax and employee’s national insurance contributions due on this amount before payment to the claimant.
