On hearing the Respondent’s application for the Claimant’s claim to be struck out or made the subject of a deposit order (or more than one):[1]The Claimant’s claim of race discrimination stands no reasonable prospect of success and is struck out.[2]The Claimant’s claim of sex discrimination as amended stands no reasonable prospect of success and is struck out.[3]The Claimant’s claim of unauthorised deduction from wages is dismissed on withdrawal.[4]The remaining claim (constructive unfair dismissal) proceeds subject to the payment of a deposit order. _____________________________ Employment Judge Norris Date: 9 February 2025REASONS
[1]The claimant was ordered to pay a deposit of £300 following a preliminary hearing held on 9 February 2025. The Order was sent to the claimant on 9 February 2025. The claimant has failed to pay this deposit. The complaint of constructive unfair dismissal, which was the only remaining complaint in this claim, is therefore struck out under rule 40(4) of the Employment Tribunal Procedure Rules 2024.[2]The hearing fixed for 3 September 2025 will not take place.
