JUDGMENT
The claim is struck out.REASONS
[1]This is a claim against a company that is in voluntary liquidation. The liquidator has confirmed to the tribunal that the liquidation is nearing closure, but it is unlikely that there will be sufficient assets to make any payment to the Claimant.[2]The Claimant has been advised that he can claim certain payments from the Redundancy Payments Service and the Tribunal believes he has received such payments.[3]The Claimant confirmed in a letter to the Tribunal dated 21 September 2021 that he wished to continue to pursue his claim, notwithstanding the liquidation, and the likelihood that he will not recover any money.[4]By an email dated 14 December 2021, the Tribunal asked the Claimant to provide a breakdown of what he was claiming in order that a judgment under rule 21 could be considered. The Claimant has failed to respond.[5]In light of the context and the Claimant’s failure to respond, I have decided that the claim should be struck out on the basis that it is no longer being actively pursued.
