JUDGMENT

On hearing Mr A Nicoll, trade union representative, on behalf of the Claimant and Ms O Dobbie, counsel, on behalf of the Respondents, it is adjudged that:(1) The Claimant’s complaint of unfair dismissal is well-founded.(2) All other claims are dismissed on withdrawal. And (on the basis of the above adjudications) it is further adjudged by consent that:(3) The Respondents do pay to the Claimant within 21 days of the date of promulgation of this judgment the sum of £2,544.20 in respect of her loss of income between the effective date of termination (‘EDT’) (30 September 2016) and the date of reinstatement (31 July 2017).(4) The Claimant be reinstated within the meaning of ss113-114 of the Employment Rights Act 1996 to the role of Team Leader working on the Respondents’ LSE contract, her first actual day of work to be 31 July 2017.(5) The Respondents shall treat the Claimant in all respects as if she had not been dismissed. This is to include: (a) the pay rise awarded in December 2016, which took the hourly pay for Team Leader from £10.42 to £10.75 (and which has been factored into the above calculation of loss); (b) continuity of employment, and Case Number: 2200287/2017 (c) annual leave accrued between EDT and 31 July 2017.
