The claim is struck out.

REASONS

[1]By a letter dated 26 July 2023 the Tribunal gave the claimant an opportunity to make representations or to request a hearing, as to why the claim should not be struck out because:[2]A preliminary hearing for case management was listed to be held on the 24th July 2023, but the claimant did not attend. The tribunal attempted to contact the claimant by telephone and email but received no reply. The claimant was ordered to write to the tribunal within 7 days of the date of the correspondence to confirm the reason for non-attendance and also to confirm that he is still actively pursuing his claim against the respondent, and that if he no longer wishes to pursue a claim against the respondent, he should confirm that he wishes to withdraw it. The claimant was warned that if no response was received, the tribunal would consider whether to strike out the claim.[3]The claimant has failed to respond to the tribunal’s letter, or to make any representations in writing why this should not be done or to request a hearing. The claim is therefore struck out on the basis that the claimant is not actively pursuing it. 2200226/2023
