Employment Judge MaidmentNot represented for claimantMrs S Cakali (instructed by Solicitor) for respondentDate 20 May 2019

JUDGMENT

The Claimant’s complaints are hereby struck out.

REASONS

The Claimant has been ordered at an earlier Preliminary Hearing to provide a copy of the contract of employment he relies upon (by 6 March 2019) and further and better particulars of his complaints of discrimination and harassment (by 20 March 2019). By Order of 25 April this hearing was listed to consider striking out the claimant’s complaints because he had no complied with the Tribunal’s orders and was not actively pursuing his claims. This was after the claimant had sought to excuse his non-compliance. The Claimant in the Order was told that he should comply as soon as possible and in any event before this hearing if he wished to avoid his claims being struck out. The Claimant has taken no such steps, has not notified the Respondent or Tribunal of any further difficulty and has (without any prior communication) not attended today’s hearing. The claimant has failed to comply with the Tribunal’s orders and is not actively pursuing his claims.
