JUDGMENT

The claimant’s complaint of unfair dismissal is struck out on the ground that it has no reasonable prospect of success.

REASONS

[1]The claimant, Mr Ali, was employed by the respondent, Capita Business Services Limited, from 17 November 2017 until 26 September 2018.[2]The claimant, therefore, did not have as the date of termination of his employment the period of not less than 2 years’ continuous employment with the respondent which section 108 of the Employment Rights Act 1996 requires to be entitled to the right not to be unfairly dismissed.[3]The Tribunal gave the claimant by letter dated 6 December 2018 the opportunity to provide reasons in writing why the complaint of unfair dismissal should not be struck out but the claimant has failed to provide any reasons or to attend the hearing today to give reasons.[4]In the circumstances the claimant’s complaint of unfair dismissal has no reasonable prospect of success and is struck out. This judgment does not affect the claimant’s separate complaint of unlawful disability discrimination within the Equality Act 2010.
