JUDGMENT
Under rule 22: Having had regard to the representations of the Secretary of State, who has been joined under rule 95; and Having had regard to the consent of the Administrator of the Respondent for the proceedings to be continued and his agreement that the essential requirements for an entitlement to a protective award were met within section 188 of the Trade Union and Labour Relations (Consolidation) Act 1992:-[1]The complaint that the respondent failed to comply with the requirements of section 188 and 188A of the Trade Union and Labour Relations (Consolidation) Act 1992 is well founded.[2]A protective award is made in favour of those claimants named in the schedule to this judgment.[3]The protective award is for a period of 90 days and began on 30 September 2024.[4]The recoupment provisions apply.
