JUDGMENT

[1]The Claimant’s complaints of disability discrimination in respect of incidents 9,5,10,14,13,15,2,3,4,12 and 26 in his grounds of complaint (and referred to then at paragraphs 6.3.1, 6.9.1, 6.9.3, 6.14.1, 6.14.3 and 6.14.4 of Employment Judge Bright’s case management summary sent to the parties on 24 October 2018) are hereby struck out. These complaints were submitted outside of the applicable time limit in circumstances where it was not just and equitable to extend time. The Tribunal therefore has no jurisdiction to hear them.[2]The Claimant’s complaint in respect of incident 25 (paragraph 6.3.2 of the case management summary) was also presented out of time but in circumstances where the Tribunal was satisfied that it was just and equitable to extend time. Such complaint can therefore proceed to a final hearing together with those additional complaints identified in this Tribunal’s case management summary arising out of the Preliminary Hearing held on 5 November 2018.
