Ms J Cumberland v The Abbeyfield York Society Ltd: 1808527/2018

EMPLOYMENT TRIBUNALS
Case No 1808527/2018
Ms J CumberlandClaimantThe Abbeyfield York Society LtdRespondent
Employment Judge DaviesDate 7 October 2021

JUDGMENT

The claim is struck out.

REASONS

[1]By a letter dated 17 September 2021 the Tribunal gave the Claimant an opportunity to explain why her claim should not be struck out, on the basis that it had not been actively pursued. This was because the Claimant has not provided a response to the Respondent’s application dated 5 May 2021 to strike out the claim, despite indicating on the same date that she would resist the application.[2]The Claimant has not responded to the Tribunal’s letter, either to explain why the claim should not be struck out or to request a hearing for that to be decided. It appears that the claim has not been actively pursued.[3]The claim is therefore struck out.
