JUDGMENT

[1]The claim, which was presented on 23 July 2018, was presented outside the time permitted by the Equality Act 2010 section 129 (taking into account also section 140B).[2]However, it would be just and equitable to extend time and accordingly the Tribunal does have jurisdiction to hear the complaints of direct disability discrimination and discrimination arising from disability as identified at the preliminary hearing conducted on 12 September 2018.[1]The claimant’s complaint of direct discrimination because of the protected characteristic of her disability fails and stands dismissed.[2]The claimant’s complaint of unfavourable treatment for something arising in consequence of disability (upon the issue of the alleged failure on the part of the respondent to offer the claimant the post of finance co-ordinator) fails and stands dismissed. Case No: 1808508/2018[3]The claimant’s complaint of unfavourable treatment for something arising in consequence of her disability (upon the issue of non-payment of a bonus) is struck out, the claimant having failed to comply with the deposit order dated 15 November 2018.
