JUDGMENT
[1]The Claimant’s complaints of unfair dismissal, for a statutory redundancy payment, for unauthorised deductions from wages, breach of contract and accrued but untaken holiday entitlement are struck out. Such claims would have lain against the third Respondent only, a dissolved company, which has not been restored to the Register of Companies. The claimant’s employment did not transfer to the fourth respondent pursuant to the Transfer of Undertakings (Protection of Employment) Regulations 2006.[2]The Claimant’s complaint of race discrimination against the first and second Respondents was brought outside the requisite three month time limit in circumstances where it was not just and equitable to extend time. This complaint is therefore struck out, the Tribunal having no jurisdiction to hear it.[3]The Claimant’s complaint of age discrimination against the first and second Respondents is dismissed upon his withdrawal of it. 10.2 Judgment - rule 61 March Case No: 1808427/2018
