JUDGMENT
[1]The complaint of breach of contract succeeds. The claimant is awarded damages in the sum of £156.60 gross (1 weeks wages).[2]The complaint of unpaid holiday pay of 84.25 hours which was outstanding on the termination of employment succeeds. In accordance with Regulation 14 of the Working Time Regulations 1998 the claimant is awarded compensation in the sum of £631.88.[3]The claimant is awarded 4 week’s pay of £626.40, for the respondents’ failure to provide the claimant with written particulars of employment in accordance with section 38 of the Employment Act 2002.
