JUDGMENT

[1]The Claimant’s complaint of unfair dismissal is struck out, the Tribunal having no jurisdiction to hear it. The complaint was presented outside the applicable three month time limit and in circumstances where the Tribunal was not satisfied that it was not reasonably practicable for the claim to have been presented in time.[2]The Claimant’s complaint of unlawful age discrimination is struck out, the Tribunal having no jurisdiction to hear it. The complaint had been brought outside the applicable three month time limit in circumstances where the Tribunal was not satisfied that it was just and equitable to extend time.

REASONS

[1]The Claimant was ordered to pay a deposit of £50.00 following a Preliminary Hearing held on 20 August 2018. The Deposit Order was sent to the Claimant on 19 September 2018. The Claimant has failed to pay this deposit. The complaint is therefore struck out under rule 39(4) of the Employment Tribunals Rules of Procedure 2013.[2]The hearing fixed for 11 December 2018 will not take place.
