Employment Tribunals Rules of Procedure 2013 – Rule 21 The Tribunal declares that the claimant has suffered unauthorised deductions from wages and awards the claimant £816 (calculated on the basis of the claimant’s hourly pay rate of £12 per hour). The amounts must be paid to the claimant on a gross basis (i.e. without any PAYE deductions for tax or national insurance contributions). NOTES[1]The respondent did not enter a response to this claim and did not attend the hearing on 6 March 2024.[2]The calculation of the amounts payable by the respondent to the claimant is set out below:a. 39 hours’ work recorded on the company’s system plus an additional 23 hours’ work recorded in a text message to the company’s accountant;b. One day’s holiday pay, calculated at 6 hours;c. 62 hours’ unpaid wages plus 6 hours’ unpaid holiday pay = 68 hours;d. 68 hours x £12 per hour = £816.
