JUDGMENT

The respondent having been served with the claimant’s claim at a trading address and remaining active on the register of companies; There being no response presented within the relevant time limits; The claimant having attended today and having conducted a final hearing in accordance with Rule 57 (see 2013 Presidential Guidance in respect of Rule 21 Judgments):[1]The claimant’s complaints of entitlement to a redundancy payment, breach of contract, unfair dismissal and failure to pay holiday pay on the termination of employment (Regulation 14 Working Time Regulations 1998) succeed.[2]The claimant’s complaints of disability and pregnancy discrimination do not succeed and are dismissed.[3]The respondent shall pay to the claimant the following sums: £ 2153.80 Statutory redundancy payment £ 1875.64 Damages in respect of unpaid notice pay £ 215.38 Unpaid gross holiday pay on termination of employment £ 53.84 25% uplift in respect of a failure to follow the ACAS code £ 4729.56 Compensatory Award in respect of unfair dismissal (including a 25% uplift in respect of a failure to follow the ACAS code). £9028.22 Total Case No: 1807332/2017[4]The recoupment provisions do not apply to the above awards.[5]This Judgment shall be copied to the company at its registered office address as identified on the register today: First Floor, 6 Park Place, Leeds, England.
