JUDGMENT
[1]The claimant is entitled to a redundancy payment in the sum of £1467 (3 weeks’ pay at the statutory maximum of £489).[2]The respondent unfairly dismissed the claimant. The respondent is ordered to pay to the claimant the sum of £4290.76 as compensation for unfair dismissal calculated as follows:- 2.1. Basic award: Nil (in view of his entitlement to a redundancy payment) 2.2. Compensatory award: £4290.76 being two months net pay at £1845.38 (£3690.76), one month loss of company car use (£200), loss of statutory rights (£400).[3]The respondent is ordered to pay to the claimant the further sum of £2156 calculated as follows:- 3.1. £200 breach of contract compensation (use of motor vehicle). 3.2. £1956 pursuant to section 38 Employment Act 2002 (failure to provide statement of terms and conditions of employment.[4]The employer’s claim by the respondent fails and is dismissed.
