JUDGMENT
[1]The respondent’s response in the claimant’s case number 1807089/2017 is struck out pursuant to the warning of 13 July 2018 because the respondent failed to answer the tribunal’s letter of 9 July 2018, failed to comply with the tribunal’s case management orders and has failed to actively pursue its defence of the claimant’s claims.[2]The respondent’s contract claim in case number 1804935/2018 is struck out for the same reason. Had I not struck the respondent’s claim out, I would have found that it failed, as no evidence was produced to support the claim.[3]The claimant’s claims of breach of contract and failure to pay holiday pay succeed. The respondent shall pay the claimant £12,513.55 in respect of his successful claims.
