JUDGMENT

[1]All the claimant’s claims of direct race discrimination, save for the claim set out in paragraph 8 of the case summary in the case management order of Employment Judge Rostant dated 14 May 2021, are STRUCK OUT on the basis that they have no reasonable prospects of success.[2]The remaining claim which has not been struck out is described in that case management order as: “8. A complaint of direct race discrimination The claimant applied for a further Band 8b post and was unsuccessful. The claimant alleges that this was an act of direct discrimination and compares himself to the successful candidate. This occurred in July 2020. The interview panel comprised Mr Siddiqi, Mr Ahmed and Mr Jones. The claimant asserts that this was another example of a policy that set Band 8a as an upper ceiling for BAME staff. He observes that all the events he complains of took place whilst the leadership of the Finance Department comprised Mr Horner, Mr Smith and Ms Lake.” 1 Case No:1806922/2020
