JUDGMENT

[1]The effective date of termination was 30th November 2017 and the very last date for presenting a claim, taking into account the period of ACAS early conciliation, was 26th April 2018. The claim was presented on 26th June 2018 and is therefore out of time[2]It was reasonably practicable to have presented any claims for unauthorised deductions from wages, breach of contract, failure to pay accrued holiday pay or for a protective award within time. In any event the claims were not presented within a further reasonable time after 26th April 2018.[3]Any claims of age or disability discrimination, even if time did not begin to run until 30th November 2017, were not presented within the period where it would be just and equitable to allow them to continue.[4]The tribunal therefore has no jurisdiction to hear this claim and it is dismissed in its entirety. Note Reasons for the judgment having been given orally at the hearing, written reasons will not be provided unless a written request is presented by either party within 14 days of the sending of this written record of the decision.
