JUDGMENT

The claim of disability related harassment is struck out.

REASONS

[1]The claimant was ordered to pay a deposit of £50 following a preliminary hearing held on 7 March 2023. The Order was sent to the claimant on 15 March 2023.The claimant has failed to pay this deposit. The complaint of disability related harassment is therefore struck out under rule 39(4) of the Employment Tribunals Rules of Procedure 2013. His remaining claims continue to hearing unless otherwise disposed.[1]On 22 May 2023 the Tribunal warned the Claimant that it was considering striking out his claim(1) because it had not been actively pursued and(2) because the Claimant had not complied with any case management orders or responded to EJ Davies’s order of 28 April 2023. The Claimant was given the opportunity to make representations as to why the claim should not be struck out, or to ask for a hearing.[2]The claimant has not responded at all. It appears to me that his claim has not been actively pursued and that he has not complied with case management orders and that the claim should be struck out.
