Miss J Sharp v Next plc: 1806708/2021
JUDGMENT
The claim is struck out.REASONS
[1]Case management orders were made in December 2021. On 14 June 2022 the Respondent’s representative wrote to the Tribunal copied to the Claimant to say that the Claimant had not complied with any of the orders. The Respondent’s representative had sent reminders and explanations to the Claimant on 25 March 2022 and 8 June 2022. The Claimant had not replied. The Respondent’s representative asked the Tribunal to consider striking out the claim or making an unless order. The Claimant did not respond to that email. The Respondent’s representative sent a reminder on 20 June 2022.[2]On 22 June 2022 the Tribunal therefore wrote to the Claimant and asked her to explain why her claim should not be struck out because it appeared she had not complied with Tribunal orders and was not actively pursuing her claim. The Claimant has not responded.[3]It appears to me that the Claimant has not actively pursued her claim and has failed entirely to comply with the Tribunal’s orders. It is in the interests of justice to strike out her claim.[4]The hearing on 1 July 2022 is cancelled. S-J Davies
