JUDGMENT
[1]The claimant’s complaint of unfair dismissal is well founded and succeeds. No order for compensation is, however, made in circumstances where the claimant would, with a 100% degree of certainty, have been fairly dismissed had a fair procedure been followed and any award would also fall to be reduced to nil due to the claimant’s conduct prior to dismissal.[2]The claimant’s claim seeking damages for breach of contract fails and is dismissed.[3]The respondent’s application for costs of 8 November 2022 is no longer pursued.
