JUDGMENT
[1]It was not reasonably practicable for Mr R Barwell, Mr G Hannam and Mr R Kirwin to present their claims within the time limit in s 189 of the Trade Union and Labour Case Numbers: 1806644/2023; 1808594/2023; 1808595/2023; 1808604/2023; 1808613/2023; 1808625/2023; 1808678/2023; 1808698/2023; 1808700/2023; 1808610/2023; 1808706/2023; 1808780/2023; 1808888/2023; 1808907/2023; 1808943/2023; 1809103/2023; 1800498/2024; 1800032/2024; 1809108/2023; 1800669/2024; 1800817/2024 Relations (Consolidation) Act 1992 and they presented their claims within a reasonable period. The Tribunal therefore has jurisdiction to deal with their claims.[2]It is declared that the complaints of failure to consult in respect of proposed dismissals contrary to s 188 of the Trade Union and Labour Relations (Consolidation) Act 1992 brought by these twenty-one former employees of Hamon UK Ltd are wellfounded.[3]The Respondent is ordered to pay to the Claimants remuneration for a protected period of 90 days from 18 September 2023.
