The complaints that the claimant was unfairly dismissed and/or is entitled to a redundancy payment are struck out.

REASONS

[1]The claimant complains of unfair dismissal and entitlement to a redundancy payment.[2]Both rights require a claimant to have not less than two years’ service.[3]The claimant was employed by the respondent for less than two years.[4]The claimant is not entitled to bring such complaints.[5]The claimant has failed to give an acceptable reason, despite being given the opportunity to do so, why the unfair dismissal complaint should not be struck out.[6]As both complaints have the same requirement it is in the interests of justice now to strike out both complaints. The claimant’s other complaint of wrongful dismissal proceeds to hearing on 13 April 2023 and is unaffected by this judgment.
