JUDGMENT
The Judgment of the Employment Tribunal is that the Claimant’s claim of unfair (constructive) dismissal under Section 98 of the Employment Rights Act 1996 is struck out and dismissed because the Claimant has insufficient service to bring the claim and has raised no circumstances in which the service requirement would not apply. This Judgment does not affect the Claimant’s claims brought under the Equality Act 2010 which shall proceed to a final hearing.
REASONS
[1]By a letter dated 14 March 2022 the Tribunal gave the claimant an opportunity to make representations or to request a hearing, as to why the claim should not be struck out because the claimant had not complied with the Order of the Tribunal 14 February 2022 it has not been actively pursued.[2]The claimant has failed to make representations in writing, or has failed to make any sufficient representations, why this should not be done or to request a hearing. The claim is therefore struck out.[3]The hearing fixed for 28 to 30 September 2022 will not take place.
