JUDGMENT
[1]The claimant’s claim for unauthorised deductions from wages succeeds. The Tribunal declares that the claimants suffered the deductions and shall be awarded the gross amount sets out below: Deductions claimed Amount awarded (gross pay) Notice pay £385 Holiday pay £371.50 One hour’s work on 21 £7.70 October 2019 Total £764.20 NOTES[2]The full hearing of this claim was originally listed for 6 January 2020. The respondent emailed the tribunal at 9:24 am on that date, stating that its director was unable to Case Number: 1806620/2019 attend the hearing due to a personal emergency. The claimant attended the hearing which was postponed.[3]Employment Judge Shepherd wrote to the parties on 6 January 2020 and ordered that the respondent should provide details and evidence of the nature of the emergency and the reason why the respondent failed to attend the hearing on 6 January 2020. The respondent failed to provide any such information.[4]The respondent failed to attend the hearing on 24 January 2020. The clerk to the Tribunal called the mobile and landline telephone numbers provided by the respondent at 2pm and left messages regarding the hearing. The respondent contacted the Tribunal at 2.35pm, after the hearing had already commenced, stating that he did not receive the Notice of Hearing but stating he received all other correspondence.[5]The Tribunal proposing to make a costs order and/or a preparation time order against the respondent in relation to the postponement of the original hearing on 6 January 2020 on the application of the claimant. Case management directions regarding such proposed order shall follow separately.
