JUDGMENT
[1]The claims of unlawful deductions from wages in respect of holiday pay for annual leave taken in June 2017 and earlier were not brought within the statutory time limit in s 23 Employment Rights Act 1996. It was reasonably practicable to bring them in time. The Tribunal therefore does not have jurisdiction to hear them and they are dismissed.[2]By consent, the Respondent shall pay the Claimant £61.84 less tax and NI in respect of underpaid holiday pay for annual leave taken in September 2017 and £174.35 less tax and NI in respect of underpaid holiday pay for annual leave taken in October 2017.[3]The Claimant agrees that he had exhausted his entitlement to Regulation 13 annual leave by December 2017 and that there was no underpayment of holiday pay for annual leave taken in December 2017.
