JUDGMENT

[1]The Respondent has made an unauthorised deduction from the Claimant’s wages and is ordered to pay to him the sum of £2111.35, comprised of £1666.35 wages agreed due between 10th August and the date of termination, 11th September 2017, and 1.38 weeks accrued holiday entitlement in the agreed sum of £445.00.[2]It is further declared that the Respondent failed to give the Claimant an itemised pay statement for either of the 4 weekly pay periods ending 7th September 2017 or 5th October 2017 and that the Claimant would be entitled to payment of the aggregate of the unnotified deductions were this sum not already covered by the above order.[3]It is further declared that the Respondent failed to provide the Claimant with a written statement of all the terms and conditions of employment required to be given under section 1(4) of the Employment Rights Act 1996 and the compensation is increased by the amount of the minimum award under section 38 Employment Act 2002, £626.24.[4]The total amount ordered to be paid by the Respondent to the Claimant is therefore £2737.59 Note Reasons for the judgment having been given orally at the hearing, written reasons will not be provided unless a written request is presented by either party within 14 days of the sending of this written record of the decision.
