JUDGMENT

UPON the Tribunal hearing from counsel and UPON the Tribunal considering the list of issues (at pages 133 to 136) inclusive of the preliminary hearing bundle:[1]It cannot be said that the complaints identified in paragraphs 7.1.1, 7.1.2, 7.1.3, 7.1.4, 7.1.5, 8.1.3 and 8.1.4 of the list of issues have no reasonable prospect of success. Accordingly, the respondent’s application for an Order that they be struck out is refused.[2]It cannot be said that the complaints identified in paragraph 1 have little reasonable prospect of success. Accordingly, the respondent’s application for an Order that the claimant shall pay a deposit as a condition of continuing with them is refused.[3]It can be said that the complaints identified in paragraphs 6, 7.1.6, 8.1.1, 8.1.2, 8.1.5 and 8.1.6 of the list of issues have no reasonable prospect of success. Accordingly, those matters stand struck out.
