JUDGMENT

[1]The respondent’s application that its Grounds of Response filed with its ET3 be declared a document protected by legal professional privilege is granted.[2]It is ordered that: 2.1. The claimant shall either destroy or return the track-changed version of the Grounds of Resistance to the respondent within 7 days of the date of this judgment. 2.2. The respondent has leave to rely on the amended clean version of the Grounds of Resistance filed with the Tribunal on 11 February 2021. 2.3. The claimant may not rely on any information in the notes to the tracked-changed Grounds of Resistance. 2.4. The claimant shall only refer to the clean amended version of the respondent’s Grounds of Resistance for the remaining duration of these proceedings. Note: This was a remote hearing. The parties did not object to the case being heard remotely. The form of remote hearing was V - video. It was not practicable to hold a face to face hearing because of the Covid19 pandemic.
