Mr D Betteridge v Swarthmore Education Centre: 1805812/2022

EMPLOYMENT TRIBUNALS
Case No 1805812/2022
Mr D BetteridgeClaimantSwarthmore Education CentreRespondent
Employment Judge JM WadeDate 1 September 2023

JUDGMENT

The claimant’s application dated 31 July 2023 to re-consider the Judgment of the Tribunal sent to the parties on 24 July 2023 is refused.

REASONS

[1]The claimant’s application is that he wishes the judgment to be “Reconsidered” and a required “Appeal”.[2]I am therefore treating this (as it was sent to the Employment Tribunal) as a reconsideration application.[3]It was copied to the respondent in accordance with Rule 92.[4]I have today signed the written reasons also sought by the claimant and I hope these will address the points he makes. In particular there are no reasonable prospects of the judgment being revoked or re-considered on the basis that: 4.1. The judgment is without merit or insight; 4.2. The hearing was conducted without the claimant’s stated disability being taken into account; 4.3. That justice was not done.[5]In all these circumstances, my assessment, as required by the Tribunal’s Rule 72(1), is that there are no reasonable prospects of the judgment being revoked or varied. I also take this opportunity to confirm that at the date of this hearing Tribunal hearings were not recorded and there is no transcript of the hearing. 1 September 2023
