JUDGMENT
[1]The respondent has made unauthorised deductions from the claimant’s wages: 1.1. by failing to pay her the remuneration due for the 44 working days worked by her between 7 March 2022 and 5 May 2022 inclusive, and 1.2. by failing to pay her the holiday pay due following the ending of her contract of employment.[2]The respondent shall pay to the claimant the sum of £1017.44 being the amount of the unauthorised deduction referred to in paragraph 1.1. (The claimant undertook 44 days of work at a daily rate of £85. She was therefore entitled to gross remuneration in the sum of £3740. She was paid £2722.56. No payment was made by the respondent to HMRC. Accordingly, the deduction in the sum of £1017.44 was unauthorised).[3]The respondent shall pay to claimant the sum of £212.50 for accrued but unpaid holiday pay referred to in paragraph 1.2. (She had accrued a holiday entitlement of 4.5 days at the date of termination of the contract of employment. She had taken two days of holiday and therefore had an accrued but untaken entitlement of 2.5 days.
