JUDGMENT
The claim fails and is dismissed.REASONS
[1]The background to this claim is set out in the Record of the hearing that took place on 13 December 2023 and I do not propose to repeat it here.[2]The case was listed for a final hearing on 13 December 2023. The claimant attended that hearing but the respondent did not. No response has been filed to the claim and the respondent has played no part in the proceedings. The respondent did not attend the hearing today either.[3]It was not possible at the last hearing to identify the correct respondent. St Patrick’s CASE NO: 1805403/2023 Social Club does not appear to be a legal entity. I adjourned the hearing to give the claimant the opportunity to make further enquiries as to the legal entity that employed her. It appears that the respondent is an unincorporated association. I suggested to the claimant that she try to get the names and addresses of the members of the management committee.[4]During today’s hearing the claimant told me that she had made further enquiries and been told that the respondent was a private members club run by a management committee. She has been unable to get the names and addresses of members of the management committee.[5]In the circumstances, the claim can go no further. I cannot issue a judgment ordering St Patrick’s Catholic Club to make a payment to the claimant because St Patrick’s Catholic Club does not exist as a legal entity.[6]It is with regret therefore that I have no option other than to dismiss the claim.
